  2. If the processing is necessary for the fulfillment of a contract or for the implementation of pre-contractual measures requested by you, Art. 6 para. 1 sentence 1 lit. b) DS-GVO is the legal basis.

Disclosure of Personal Data to Third Parties and Data Processors:

Without your consent, we generally do not disclose data to third parties. If this should nevertheless occur, the disclosure is based on the legal bases mentioned above, e.g., for the purpose of contract fulfillment or due to a court order or legal obligation to disclose data for the purpose of law enforcement, danger prevention, or enforcement of intellectual property rights. We also use data processors (external service providers, e.g., for web hosting of our websites and databases) to process your data. If data is passed on to data processors within the framework of an order processing agreement, this is always done in accordance with Art. 28 DS-GVO. We carefully select our data processors, check them regularly, and have them grant us a right of instruction regarding the data. In addition, data processors must have taken suitable technical and organizational measures and comply with data protection regulations in accordance with BDSG n.F. and DS-GVO.

Data Transfer to Third Countries:

With the adoption of the European General Data Protection Regulation (DS-GVO), a uniform basis for data protection in Europe was created.

Transfer of Data to Third Countries:

Due to the creation of the European General Data Protection Regulation (DS-GVO), your data is primarily processed by companies to which the DS-GVO applies. If processing by third-party services outside the European Union or the European Economic Area does occur, these services must meet the special requirements of Art. 44 et seq. DS-GVO. This means that processing takes place due to special guarantees, such as the officially recognized determination of a level of data protection equivalent to that of the EU by the EU Commission or compliance with officially recognized specific contractual obligations, the so-called “standard contractual clauses.” In the event that we obtain your explicit consent for data transfer to the USA due to the ineffectiveness of the so-called “Privacy Shield,” as per Art. 49 para. 1 sentence 1 lit. a) DSGVO, we would like to draw your attention to the risk of secret access by US authorities and the use of data for monitoring purposes, possibly without legal remedies for EU citizens.

Deletion of Data and Storage Duration:

Unless expressly stated otherwise in this privacy policy, your personal data will be deleted or blocked as soon as the consent granted for processing is revoked, or the purpose for storage ceases to apply, or the data is no longer required for the purpose, unless further storage is necessary for evidentiary purposes or legal retention obligations contradict this. This includes, for example, commercial retention obligations for business letters according to § 257 para. 1 HGB (6 years) as well as tax retention obligations for documents according to § 147 para. 1 AO (10 years). When the prescribed retention period expires, your data will be blocked or deleted unless storage is still necessary for the conclusion or fulfillment of a contract.

Existence of Automated Decision-Making:

We do not use automated decision-making or profiling.
